Terms of Use

Effective Date: 2022-03-21

1. WHO WE ARE

This Privacy Policy explains how Hurricane Safety Program LLC (“HSP,” “we,” “us,” or “our”) collects, uses, shares, and protects information about you when you visit hurricanesafetyprogram.org (the “Site”), contact us, submit a form, speak with one of our representatives, or participate in the Hurricane Safety Program.

Important — please read this part carefully.

Hurricane Safety Program LLC is a marketing, program administration, and contractor referral company. Hurricane Safety Program LLC is not a licensed contractor and does not perform construction work.

Construction, installation, and related licensed work arranged through the Hurricane Safety Program is performed by independent licensed and insured contractors assigned to your project. The contractor assigned to your property will be identified to you in your project documentation, and that contractor’s license number will appear on your agreement and permit paperwork.

Hurricane Safety Program LLC is also not a lender, not a bank, and not an insurance company. We do not make lending decisions, we do not set interest rates, and we do not determine insurance premiums or coverage.

2. INFORMATION WE COLLECT

2.1 Information you give us

When you fill out a form on our Site, respond to an advertisement, speak with a representative at your door, call or text us, or participate in the program, we may collect:

  • Your name
  • Your home address and the address of the property
  • Your phone number(s) and email address
  • Your preferred language
  • Whether you own the home
  • Information about your property — roof age, window and door type, existing storm protection, HVAC and utility details, general condition
  • Your current insurance carrier and general policy information, if you choose to share it
  • Photographs, measurements, and inspection notes taken during a property assessment
  • Appointment scheduling details and your communication preferences
  • Any other information you choose to give us in a message, form field, or conversation

2.2 Information collected automatically when you use the Site

  • IP address and general location derived from it
  • Device type, operating system, and browser
  • Pages you viewed, links you clicked, time spent, and referring website
  • Advertising and analytics identifiers set by cookies, pixels, and similar technologies

See Section 6 (Cookies and Tracking) for details and your choices.

2.3 Information we obtain from other sources

We obtain information about homeowners and properties from third parties, including in some cases before you have contacted us. This may include:

  • Public records and property data — year built, permit history, ownership records, assessed and estimated property value, estimated equity position, length of ownership
  • Consumer data providers and data brokers — contact information, household demographic information, and property attributes
  • Advertising platforms — lead information you submitted through an advertisement on a platform such as Facebook or Instagram
  • Referral sources — partners, affiliates, and past customers who refer you
  • Marketing lists — contact lists obtained from list vendors and lead providers

2.4 Recorded calls and meetings

We record telephone calls, video meetings, and in-home appointments for quality assurance, training, coaching, and record-keeping purposes.

Florida law generally requires the consent of all parties to record a conversation. We will notify you before recording begins, and you may decline to be recorded or ask that recording stop at any time. If you decline, we will continue to assist you — declining a recording does not disqualify you from the program.

2.5 Financing information

If you choose to apply for consumer financing, your application is submitted to and processed by the finance company, not by us. We do not collect or store your Social Security number, full credit report, or complete credit file. [VERIFY — confirm exactly what financing data HSP touches, stores, or transmits, including anything captured in the CRM or on a paper application. This sentence must match actual practice.]

We may receive from the finance company limited status information such as whether an application was approved, the approved amount, and the term selected.

2.6 Sensitive information

We do not seek to collect sensitive personal information such as Social Security numbers, government ID numbers, financial account numbers, health information, or precise geolocation. Please do not send this information to us by email, text message, or web form.

3. HOW WE USE INFORMATION

We use the information described above to:

  • Determine whether a property may qualify for the program
  • Contact you by phone, text message, and email about the program, your inquiry, and your appointment
  • Schedule, confirm, and conduct property assessments and appointments
  • Prepare a scope of work and program documentation for your property
  • Coordinate permitting, inspection, installation, and warranty service with the assigned contractor and its subcontractors
  • Refer you to consumer finance companies at your request
  • Provide customer service and respond to questions and complaints
  • Train and coach our representatives and improve the quality of our program
  • Measure and improve our advertising, including matching and conversion tracking with advertising platforms
  • Maintain records, resolve disputes, enforce agreements, and comply with law
  • Detect and prevent fraud and protect the security of our systems

4. HOW WE SHARE INFORMATION

We share your information with the following categories of recipients:

4.1 Assigned contractors and trade partners

We share your name, contact information, property address, scope details, photographs, and assessment notes with the independent licensed contractors, subcontractors, suppliers, permit runners, and inspectors assigned to your project so the work can be performed.

We work with a network of installation partners and select the contractor for each project based on trade, market, availability, and scheduling. This means your information may be shared with a contractor you have not previously dealt with. The contractor assigned to your project will be identified to you before work begins. Each contractor in our network is contractually required to protect your information and to use it only to perform work on your property.

4.2 Consumer finance companies

If you ask us to help you explore financing, we share your name, contact information, property address, and the requested project amount with consumer finance companies. We only do this at your direction. Once your information reaches a finance company, that company’s own privacy policy governs how it uses your information. We do not control their practices.

4.3 Service providers

We share information with vendors that operate our business under contract, including:

  • Customer relationship management and marketing automation platforms
  • Telephone, text messaging, and email delivery providers
  • Call recording, transcription, and meeting recording providers
  • Web hosting, analytics, and website security providers
  • Document signing and storage providers
  • Property data enrichment providers
  • Accounting, payment processing, and professional services providers

4.4 Advertising platforms — please read

We share limited information with advertising platforms, including Meta (Facebook and Instagram) and Google, so that we can measure our advertising and show ads to people who may be interested in the program. This may include a hashed version of your email address or phone number, and information about actions you take on our Site.

Under several state privacy laws, this activity may be considered a “sale” of personal information or “sharing” for targeted advertising, even though we do not receive money for it. You can opt out. See Section 7 (Your Choices and Rights).

4.5 Legal and business transfers

We may disclose information when we reasonably believe it is required by law, subpoena, court order, or governmental request; to establish, exercise, or defend legal claims; to enforce our agreements; to protect the rights, safety, or property of any person; or in connection with a merger, acquisition, financing, reorganization, or sale of assets.

4.6 What we do not do

We do not sell your information to unrelated third parties for their own independent marketing purposes. [VERIFY — this statement must be confirmed as accurate against all current data flows, including any lead-sharing, lead-resale, or partner arrangements. If HSP shares or resells leads to any outside company, this sentence must be removed or rewritten.]

5. TEXT MESSAGES, CALLS, AND EMAIL

5.1 Consent

By giving us your phone number, you agree that we and the contractor assigned to your project may contact you at that number by phone call and text message, including through automated technology, about the Hurricane Safety Program and your inquiry.

Consent is not a condition of purchase or of participating in the program. You may participate without agreeing to receive automated calls or texts.

5.2 Message frequency, rates, and carriers

Message frequency varies. Message and data rates may apply. Mobile carriers are not liable for delayed or undelivered messages.

5.3 How to stop messages

  • To stop text messages: reply STOP to any text message from us. You will receive one confirmation message, and we will stop sending marketing texts to that number.
  • For help: reply HELP to any text message, or contact us using the information in Section 1.
  • To stop marketing emails: click the unsubscribe link at the bottom of any marketing email, or contact us.
  • To stop marketing phone calls: tell any representative you want to be placed on our internal Do Not Call list, or contact us using the information in Section 1.

We honor opt-out requests promptly and in all cases within the time required by law. We maintain an internal Do Not Call list and honor requests to be added to it for at least five years.

Even after you opt out of marketing, we may still contact you about an active project, appointment, warranty, or service matter, or as required by law.

6. COOKIES AND TRACKING TECHNOLOGIES

Our Site uses cookies, pixels, tags, and similar technologies. These include:

  • Strictly necessary technologies that make the Site work and keep it secure
  • Analytics technologies that tell us how visitors use the Site
  • Advertising technologies, including the Meta Pixel and Google advertising tags, that measure ad performance and support ad targeting

You can control cookies through your browser settings. Blocking some cookies may affect how the Site works.

Global Privacy Control. If your browser or extension sends a Global Privacy Control (GPC) signal, we treat that signal as a valid request to opt out of the sale or sharing of your personal information for targeted advertising for that browser. [VERIFY — do not publish this sentence until GPC honoring is actually implemented on the Site. Publishing an unimplemented commitment is worse than saying nothing.]

7. YOUR CHOICES AND RIGHTS

Regardless of where you live, you may ask us to:

  • Access the personal information we hold about you
  • Correct information that is inaccurate
  • Delete your personal information, subject to legal and contractual retention requirements
  • Opt out of marketing calls, texts, and emails
  • Opt out of the sale or sharing of your personal information for targeted advertising

How to make a request: email [INSERT PRIVACY EMAIL], call [INSERT PHONE NUMBER], or write to us at the address in Section 1. We will verify your identity before acting on a request, and we will respond within the time required by applicable law.

Do Not Sell or Share My Personal Information. To opt out of the sharing of your information with advertising platforms for targeted advertising, use the “Do Not Sell or Share My Personal Information” link in the footer of our Site, submit a request using the contact details above, or enable Global Privacy Control in your browser. [VERIFY — the footer link must actually exist and function before this sentence publishes.]

Authorized agents. You may use an authorized agent to submit a request on your behalf. We may ask for proof of authorization.

No retaliation. We will not deny you the program, charge you a different price, or provide you a lower quality of service because you exercised a privacy right.

Residents of states with comprehensive privacy laws (including California, Virginia, Colorado, Connecticut, Texas, and others) may have additional rights, including the right to appeal a denied request. To appeal, reply to our response or contact us using the details in Section 1. [COUNSEL — confirm which state statutes HSP is actually subject to based on consumer counts and revenue, and whether a state-specific rights section or a separate California notice is required.]

8. HOW LONG WE KEEP INFORMATION

We keep personal information for as long as needed for the purposes described in this policy, and afterward as required for legal, tax, warranty, licensing, insurance, and dispute-resolution purposes.

General retention practice:

  • Contact and marketing records: [INSERT PERIOD] after last activity
  • Project, contract, and warranty records: [INSERT PERIOD — should align with Florida’s statute of repose and warranty obligations]
  • Call and meeting recordings: [INSERT PERIOD]
  • Do Not Call and opt-out records: at least five years

[COUNSEL / OPS — retention periods must be set deliberately. Keeping recordings and lead data indefinitely increases both litigation discovery exposure and breach exposure.]

9. SECURITY

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls, encryption in transit, and vendor agreements. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. CHILDREN

The Site and the program are directed to homeowners who are 18 or older. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.

11. THIRD-PARTY WEBSITES

Our Site may link to websites we do not control, including finance company application portals, review sites, and social media pages. This policy does not apply to those sites. Review their privacy policies before providing information.

12. CHANGES TO THIS POLICY

We may update this policy. When we do, we will change the “Last Updated” date at the top. If we make a material change, we will provide additional notice, such as a notice on the Site or an email. Your continued use of the Site after an update means you accept the updated policy.
